Is it Kidnapping?

me asked:

If a father and mother divorces ad they both share custody of a child but the mother leaves and takes the child with out the father knowing and no longer has contact with the father is that kidnapping? If she skips the country with the child but you don’t live in America. What if she takes the child from England to Spain!!!!!!

    She is in contempt of court and has kidnapped the child.
    If you plan it, don’t do it.
    If your mother has done it, contact the authorities.
    Or call your Dad and tell him where you are.

    Title 18, United States Code, Section 1204, enacted in 1993 (the International Parental Kidnapping Act, IPKA), makes it an offense to remove a child who has been in the United States from the United States with the intent to obstruct the lawful exercise of parental rights. Such an offense is punishable by a fine under Title 18, imprisonment for not more than three years, or both.

    Yeah, you probalby dont realize it but your actually hurting your kid even more. You cant just take away your child from the father. Since you did that and if they catch you, you can loose your child now wouldn’t that be bad. In the long run your kid is going to suffer more then any one. I could see if the father was abusive but if it was regular divorce its a little differnt. I strongly advise you get in touch with him before he reports to the police. Or you could just leave the country and make it harder for your child to never see her father again. You really think that she will do well without a father?

    as long as there is a court order that they are on a shared parenting then yes that is kidnapping and she could loose all rights to that child. if you know where she is then you can call the cops and get the child and file for kidnapping charges, as long as she is in the us. if she went to another country then you have to wait for her to come back, i would call an attorney

    Yes, it is.
    I live in the U.S. and my mom and I were going on a vacation to Mexico–I was 13 or so, and my parents had been divorced for years–and they would NOT let me get on the plane. I had to have a signed official note from my father–and it couldn’t even be faxed. It was intense.
    Be careful. You might be able to get on the plane if they slip up…but if the father comes looking, you’ll be in really big trouble.
